The following article entitled The Superior Role of the President of the Republic of Poland in the Provisions of the Constitution of 23 April 1935 is a formal and dogmatic analysis of the constitutional and legal position of the President of the Republic of Poland, along with his competences and superior powers concerning the central, constitutional bodies of the state, i.e. the Government, the Parliament, the Senate, the Courts, the Armed Forces and the State Control.
In this matter, the Constitution distinguished two forms of the official acts of the President – decrees and orders regarding control over the Parliament, the Senate and the Government, powers in the area of the judiciary, the State Control, foreign policy and the Armed Forces. It required conducting research not only on the provisions of the Constitution of 23 April 1935, but also on decrees, acts and regulations issued under its authorization, addressed mainly to legislative, executive, judicial and control bodies.
The historical and legal analysis of the acts mentioned above, after conducting a thorough interpretation, allowed for noticing the active role of the President in the new constitutional framework of the state. The exact reconstruction of the conditions for their establishment, as well as the practice of their application, including the legal effects they had on the practice of acting within their constitutional duties and powers, showed the active, superior, and therefore the key role of the Head of State in the conditions of the Constitution of 1935. The aim of this article was to present the results of research illustrating the elements of the constitutional and legal superiority of the President of the Republic of Poland in the provisions of the April Constitution of 1935.
