Abstract

This paper addresses selected legal issues concerning the functioning of the Central Election Commission (CEC) within the framework of Georgia’s electoral administration. The topic is particularly pertinent in the light of the upcoming 2024 Georgian presidential elections, which are accompanied by significant public expectations. The purpose of this article is to examine the legal status of the CEC, grounded in the normative framework of the Georgian Election Code and in other subordinate regulations. This issue has not been the subject of any significant scholarly attention within the Georgian legal doctrine, and the Election Code of Georgia has not yet been subject to comprehensive commentary. The avoidance of this topic by legal scholars may be interpreted as a reluctance to engage into potential criticism that could provoke reprisals from the authorities. This study employs a doctrinal legal analysis, focusing on the relevant legislative acts to address the research question concerning the role and functions of the CEC and its organs in the enforcement of electoral law in Georgia.
